1. Acceptance of Terms
By accessing or using ResumePros.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
ResumePros.ai is an AI-powered resume optimization platform. The Service allows users to upload resumes, input job descriptions, and receive AI-generated analysis, suggestions, and optimized resume content. The Service is provided on an "as is" basis and is intended for personal, non-commercial use unless otherwise agreed in writing.
3. Eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
4. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@resumepros.ai of any unauthorized use of your account.
We reserve the right to terminate or suspend accounts at our discretion, including for violation of these Terms, suspected fraudulent activity, or abuse of the Service.
5. Acceptable Use
You agree not to use the Service to:
- Upload content that is unlawful, harmful, defamatory, or infringing on third-party rights.
- Attempt to reverse-engineer, scrape, or extract data from the Service in an automated manner.
- Submit false or misleading information for the purpose of deceiving employers.
- Use the Service to generate content for mass distribution, spam, or commercial resale without our written consent.
- Circumvent any security or rate-limiting measures implemented by the Service.
- Impersonate any person or entity.
6. User Content
You retain ownership of the content you upload to the Service, including your resume and job description data ("User Content"). By uploading User Content, you grant ResumePros.ai a limited, non-exclusive, royalty-free license to process and store your User Content solely for the purpose of providing the Service to you.
We do not sell your User Content to third parties. We do not use your User Content to train AI models without your explicit consent. You are solely responsible for ensuring that your User Content does not infringe any third-party rights.
7. AI-Generated Content
The Service uses AI to generate resume suggestions and optimized content. You acknowledge that:
- AI-generated content may contain inaccuracies, errors, or outputs that do not match your actual experience.
- You are solely responsible for reviewing, verifying, and editing any AI-generated content before using it in applications or submissions to employers.
- ResumePros.ai makes no guarantee that AI-generated resumes will result in job interviews, offers, or any particular outcome.
8. Intellectual Property
All content, design, code, and materials comprising the Service (excluding User Content) are the intellectual property of ResumePros.ai or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Service without our prior written permission.
9. Payments and Subscriptions
Certain features of the Service may require a paid subscription. Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for the applicable fees. All fees are non-refundable except where required by applicable law or expressly stated otherwise. We reserve the right to modify pricing with reasonable advance notice.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RESUMEPROS.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED US DOLLARS (USD $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless ResumePros.ai and its affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.
13. Termination
You may terminate your account at any time by contacting us at support@resumepros.ai. We may terminate or suspend your access to the Service immediately and without notice if you violate these Terms or if we discontinue the Service.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
15. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or in a court of competent jurisdiction.
